Barker Ridge Artist Mall Membership Agreement

The following binding agreement sets forth the terms and conditions
which must be met to become a member of the Barker Ridge Artist
Mall.

  • The initial term for this agreement is six(6) months.
  • The effective start date is the day that the Artists Items are
    published and available for purchase from the Barker Ridge Artist
    Mall Website.
  • After the initial six(6) months, I understand that services will
    continue at the normal current published rates (see Fee
    Schedule for current rates) until the Artist/Craftsman gives
    notification requesting cancellation.
  • Barker Ridge Artist Mall agrees to provide the following services:

   1 - create your multi-page web store with your assistance and
           final approval of course.
   2 - add your products to our catalog.
   3 - regularly scheduled web page and catalog maintenance.
   4 - monthly reports on your store activity.
   5 - maintain a PayPal Website Payment Account to accept
        Credit Card payments for your merchandise.             
   6 - receive your orders.
   7 - send you, your customer order information, payments and
        shipping charges as soon as the customers check clears or
        credit card has been processed.
   8 - make required WV sales tax payments, PayPal transaction
        Fees, Website Transaction Fees and Sales/Advertising Fees.
 10 - advertise the Barker Ridge Mall Website to the best of our
        ability .
  11 - Barker Ridge Artist Mall will maintain our website on a
         continuing basis but will not be libel for problems
         associated with the World Wide Web or its usage by the
         Member or our visitors.
  12 - The Barker Ridge Artist Mall will send you an invoice for
          your monthly fees, at the beginning of each month for
          which the agreement is in effect. Payment of that invoice is
          expected by the 15th of that month for which the invoice is
          issued. Receipt of payment will be sent by E-mail.
  • Your web pages are personal to you and are not transferable.
  • The Barker Ridge Artist Mall Fee Schedule is made part of this
    agreement by this reference.  All fees states are in U.S.dollars ($)
  • The Barker Ridge Artist Mall may amend this agreement or any
    schedule forming a part of this agreement (for example only: the
    fee schedule) from time to time by posting the changes within
    this agreement under the heading "amendments".  Any posted
    amendment shall become binding within thirty (30) days after it
    is first posted on the site. You are responsible for periodically
    reviewing the Member Agreement and its amendments.  Your
    continued use of the site shall constitute your acceptance of the
    agreement as amended.  If you do not agree to any such
    amendment, you must notify us immediately.
  • I understand that The Barker Ridge Artist Mall shall be owed a
    fee per our current Fee Schedule, due and payable upon
    execution of this agreement, for the listing of my items on the site
    whether or not such item ultimately sells.
  • Regarding the Artist/Crafter's business requirements and items
    that are displayed within the Barker Ridge Artist Mall:
          1 - I must be a registered business
               owner and be able to supply Barker Ridge Artist Mall
               with a legal Tax Number.
          2 - I must be juried by a recognisable organization or by
               The Barker Ridge Artist Mall staff.
          3 - I guarantee Barker Ridge Artist Mall that all items
                submitted for publication within the Mall is your own
                company's original work, handcrafted by you, the
                submitting artist.
          4 - I must keep the items published in the catalog on
                hand for immediate delivery unless they are made to
                order items.
          5 - I must notify Barker Ridge Artist Mall
                immediately to remove any item from the catalog that
                cannot be delivered in a timely manner, is no longer
                available, or impossible to deliver. Any problem incurring
                with delays in shipment will null and void this agreement
                and you will forfeit any current or future relationships
                with Barker Ridge Artist Mall.
          6 - I agree that Barker Ridge Artist Mall may use any
               graphics or information provided by me for publication in
               our Mall Catalog and web pages to promote the site.
          7 - Barker Ridge Artist Mall shall in its sole discretion, have
                the right of final determination on the acceptability of all
                artwork and crafts displayed for sale as well as the
                design, nature and content of the web pages.
          8 - You are responsible for determining the wholesale price
                and shipping charges for each item displayed in the Mall
                Catalog.
  • I understand that my order may be refused by Barker Ridge
    Artist Mall for any reason.
  • I understand that I will be dealing directly with the customer and
    will not have recourse against Barker Ridge Artist Mall for any
    reason.
  • I agree to indemnify, defend and hold harmless Barker Ridge
    Artist Mall from any claims for any reason.
  • By printing, signing and returning this agreement to Barker
    Ridge Artist Mall, I acknowledge that I have read and agree to all
    terms and amendments in this agreement.
